Clearingvitabone provides lifestyle coaching and educational resources focused on sleep habits, routines, and general wellness. Our Services are designed to support personal development and are not a substitute for professional medical, psychological, or legal advice.

Results vary between individuals. We do not guarantee specific sleep outcomes, performance improvements, or health benefits. Any examples or testimonials reflect individual experiences and are not promises of similar results.

04 Eligibility

You must be at least 18 years old and have the legal capacity to enter a binding contract to use our Services. By using the Website, you represent that you meet these requirements.

If you access the Website on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We may refuse or terminate access to anyone who violates these Terms, poses a risk to others, or where we are legally unable to provide Services in a given jurisdiction.

05 Accounts

Where we offer account registration, you agree to provide accurate, current information and to keep your login credentials confidential. You are responsible for all activity under your account.

• Notify us immediately at service@clearingvitabone.world if you suspect unauthorized access.
• Do not share passwords or allow others to use your account.
• We may suspend or delete accounts that are inactive, fraudulent, or in breach of these Terms.

We reserve the right to refuse registration or to require additional verification before granting access to certain features or paid programs.

06 User Conduct

• Record coaching sessions without our prior written consent where recording is restricted by law or contract

We may investigate violations and cooperate with law enforcement where required. Serious or repeated breaches may result in immediate termination without refund, except where mandatory consumer law provides otherwise.

07 Intellectual Property

All Content on the Website and provided through Services—including logos, text, graphics, protocols, and course materials—is owned by Clearingvitabone or our licensors and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access Content for personal, non-commercial use in connection with Services you have purchased. You may not modify, publish, sublicense, or create derivative works without our written permission.

08 Payment

Fees for Services are displayed at checkout or in a separate proposal. Unless stated otherwise, prices are in euros (EUR) and include applicable VAT where required by Dutch law.

• Payment methods: we accept methods shown at checkout (e.g., card payments via our payment processor).
• Billing: you authorize us and our processors to charge the payment method you provide for agreed fees.
• Refunds: governed by our Refund Policy, which is incorporated into these Terms by reference.
• Late or failed payment: we may suspend Services until payment is received.

You are responsible for any bank fees or currency conversion charges imposed by your financial institution.

09 Disclaimers

10 Limitation of Liability

To the maximum extent permitted by applicable law, Clearingvitabone and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Website or Services.

Our total aggregate liability for any claims arising out of or related to these Terms or Services shall not exceed the greater of (a) the amount you paid us for Services in the twelve (12) months before the claim, or (b) one hundred euros (EUR 100), except where liability cannot be limited under mandatory consumer protection law.

11 Indemnification

You agree to indemnify, defend, and hold harmless Clearingvitabone and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website or Services, violation of third-party rights, or content you submit to us.

We reserve the right to assume exclusive defense of any matter subject to indemnification; you agree to cooperate reasonably with our defense. This section does not apply to the extent prohibited for consumers under mandatory law.

12 Termination

You may stop using the Website at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, fail to pay fees, or if we discontinue the Website or a specific Service.

Upon termination, your right to use the Website and licensed Content ends, except that provisions which by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution) remain in effect.

Termination does not relieve you of payment obligations for Services already delivered or fees incurred before termination.

13 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles that would require application of another jurisdiction's laws.

If you are a consumer habitually resident in the European Union, you also benefit from mandatory protections of the laws of your country of residence where they cannot be derogated from by agreement.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

14 Dispute Resolution

We encourage you to contact us first at service@clearingvitabone.world to resolve concerns informally. Most issues can be addressed promptly through good-faith discussion.

If a dispute cannot be resolved informally, it shall be submitted to the competent courts of Amsterdam, the Netherlands, unless mandatory consumer law grants you the right to bring proceedings in your country of residence.

EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution procedures before a consumer arbitration body unless required by law.

15 Changes to Terms

We may update these Terms to reflect changes in our Services, legal requirements, or business practices. The "Last updated" date at the top indicates the latest version.

Material changes will be posted on the Website with reasonable notice. Where required by law, we will seek your acceptance before changes apply to ongoing paid Services. If you do not agree to updated Terms, you must stop using the Website and may cancel future Services according to our Refund Policy.
